Revenge termination

 

Case example:
Marija asks critical questions at her workplace regarding her rights as a mother and complains to the department manager about how badly she and other mothers are being treated at work. She is then terminated on the following day.

 

This is what you can do in such a case:

1. If you are terminated because you ask critical questions and complain about discrimination at your workplace, this can represent "revenge termination".

2. Demand a written reason for the termination.

3. Initiate an arbitration within the notice period (How does this work?). In an arbitration you can demand a reversal of the termination and therefore achieve reinstatement or up to six months of pay as compensation.

 

Good to know:

> If you defend yourself against discrimination this cannot have a negative effect on your job reference.

 

The Gender Equality Act protects you against terminations (art. 10 GlG) if you are defending yourself against discrimination.
